Attacks of anti-Soviet propaganda against justice
Trust is an important, but not the only element on which the effectiveness of protection depends. It is equally important that protection contributes to the establishment of the truth and, ultimately, the proper administration of justice. But for protection to be such, it is quite obvious that those who knowingly pursue goals contrary to the goals of justice should not have access to its implementation, first of all. This, in particular, explains the fact that the current legislation, speaking about the possibility of admission as a defender of "another person" (that is, a person who is not a lawyer, a representative of a trade union, a close relative of the accused, etc.), emphasizes that such a person is allowed to consider the case by a court ruling or a judge's order. In other words, the law provides for the possibility of judicial control over the reasonableness of attracting such persons to perform the responsible role of a defender.
It would be possible not to talk about all these legal subtleties in such detail if it were not for some attacks of anti-Soviet propaganda. Composing myths about the existence of a certain "opposition" in the USSR, whose representatives are persecuted only for their views and beliefs, this propaganda began to inflate another ridiculous fiction: that "sufferers for beliefs" are deprived of the opportunity to defend themselves. To make it more convincing, the names of some, in particular American, lawyers who have expressed a desire to come to the Soviet Union and take on the duties of defenders of these people are being heavily advertised. Some of the lawyers even began to speak on the pages of the Western press with demands that the relevant Soviet authorities positively resolve the issue of their admission to the trial of specific court cases. At the same time, it was made clear that if such a claim had been made in any judicial authority of the United States or another country of the "free world", it would certainly have been satisfied.
It is difficult to determine what is more behind these claims — the desire for dubious popularity, hypocrisy or rejection of everything connected with the USSR. It is not difficult, however, to identify some oddities in these claims. An American lawyer can get a discount if he does not know the legislation of another country. But when he starts demanding from the authorities of another country what he has no right to even at home, it already smacks of bad taste.
It is appropriate in this regard to recall what is sometimes deliberately silent. For it is impossible to believe that professionals do not know the elementary provisions of the legislation of their country, which regulate the admission of lawyers to practice in courts.
According to the laws of the state of New York, for example, only persons who have the appropriate education, experience in legal work, and meet moral requirements can practice in courts (including as defenders).
